ADS Engineering GmbH Privacy Policy

Thank you for your interest in our company. In principle, it is possible to use our website http://ads-engineering.ch and our apps without providing any personal data. However, the processing of personal data is necessary insofar as the data subject contacts us, places orders, etc. via our website or uses other special services provided by our company. If there is no legal basis for such processing, we generally ask the data subject for permission. ADS Engineering GmbH is committed to maintaining confidentiality. However, our websites and apps may include links to third-party websites and apps, etc. that are not covered by this Privacy Policy.

The processing of personal data, such as a data subject’s name, address, email address or telephone number, is always carried out in accordance with the statutory provisions. With this Privacy Policy, our company would like to inform the data subject about the nature, scope and purpose of the personal data we collect, use and process and advise them of their rights. ADS Engineering GmbH uses the personal information you provide only within the framework of the customer relationship between you and ADS Engineering GmbH. For example, if you have signed up for our newsletter, we will use your email address to send you the latest information by email. No personal data (e.g. email address, name, profiles, etc.) is disclosed or sold to other companies or private individuals in any form. This excludes partner companies as part of order processing (credit card, postal service, etc.).

ADS Engineering GmbH has implemented numerous technical and organisational measures to ensure the most seamless protection possible of the personal data that is processed via this website. Nevertheless, security gaps may arise when transferring data over the internet, which means that absolute protection cannot be guaranteed. For this reason, every data subject is free to use alternative means of sending us their personal data, such as by telephone.

The terms used in this Privacy Policy correspond to the definitions found in the EU GDPR.

3. Cookies

The ADS Engineering GmbH website uses cookies.

Cookies are text files that are placed and stored on a computer system via a web browser. By using cookies, ADS Engineering GmbH can provide users of this website with more user-friendly services that would not be possible otherwise. A cookie can be used to optimise the information and services provided on our website with the user in mind. Cookies allow us to recognise the users of our website. The purpose of recognising users is to make it easier for them to use our website. For example, the user of a website that uses cookies does not need to enter their login details again every time they visit the site, because this is handled by the website and the cookie stored on the user’s computer system.

Data subjects can always configure their web browser to block cookies from our website, thereby permanently opting out of the placing of cookies. Furthermore, cookies placed in the past can be deleted at any time via a web browser or other software programmes. This is possible in all current web browsers. If the data subject deactivates the placing of cookies in the web browser they are using, it may not be possible to use all of our website’s features in full.

4. Recording of general data and information

ADS Engineering GmbH’s website collects a series of general data and information each time a data subject or an automated system accesses the site. This general data and information is stored in the server log files. The following data and information can be collected:

1. the browser types and versions used

2. the operating system used by the accessing system

3. the website from which an accessing system reaches our website (known as the referrer)

4. the subwebsites navigated to via an accessing system on our website

5. the date and time of access to the website

6. an internet protocol address (IP address)

7. the internet service provider of the accessing system

8. other similar data and information used for security purposes in the event of attacks on our information technology systems.

When using this general data and information, ADS Engineering GmbH does not draw any conclusions about the data subject. Instead, this information is needed in order to:

1. deliver the content of our website correctly

2. optimise the content of our website and its advertising

3. ensure the long-term functionality of our information technology systems and the technology of our website

4. provide law enforcement authorities with the information necessary for prosecution in the event of a cyber attack.

ADS Engineering GmbH therefore analyses this anonymously collected data and information not only statistically but also with a view to increasing data protection and data security at our company, with the ultimate aim of ensuring an optimum level of protection for the personal data we process. The anonymous data in the server log files is stored separately from all personal data provided by the data subject.

5. Contact with the company via the website

Due to statutory provisions, ADS Engineering GmbH’s website includes information that allows rapid electronic contact with the company as well as direct communication with us. This also includes a general email address. Insofar as a data subject contacts the controller by email or via a contact form, the personal data sent by the data subject is saved automatically. Personal data of this kind transmitted to the controller voluntarily by a data subject is stored for the purpose of handling the data subject’s request or for contacting them. This personal data is not disclosed to third parties.

6. Subscriptions to our newsletter and information and marketing emails

We provide our customers with the option to subscribe to our company newsletter and to keep up to date via our information and marketing emails. The personal data that is transmitted to us when subscribing to the newsletter and the circulars depends on the input form used for this purpose.

ADS Engineering GmbH informs its customers and business partners of company offers at regular intervals in the newsletter or emails. In principle, the data subject can only receive the newsletter and emails from our company if they have a valid email address and sign up to receive the newsletter.

Moreover, when people register for the newsletter, we store the IP address allocated by the internet service provider to the data subject at the time of registration, as well as the computer system used and the date and time of registration. It is necessary to collect this data so that we can trace any misuse of a data subject’s email address at a later time, thereby providing legal protection to ADS Engineering GmbH.

Personal data collected within the framework of the newsletter service is not disclosed to third parties. The data subject can cancel their subscription to our newsletter or information emails at any time. Likewise, the consent granted by the data subject for the storage of personal data for the purpose of sending the newsletter can be withdrawn at any time.

Every newsletter includes a corresponding link for the purpose of withdrawing consent. In addition, data subjects also have the option of cancelling their registration with our data protection officer at any time.

7. Routine deletion and blocking of personal data

The controller processes and stores personal data of the data subject only for the period of time that is necessary to achieve the purpose of storage or insofar as this has been provided for by the European legislature and regulatory body or another legislature in laws or regulations to which the controller is subject. If the purpose of storage no longer applies or if a storage period stipulated by the European legislature and regulatory body or another competent legislature expires, the personal data is blocked or deleted as a matter of routine in accordance with the statutory provisions.

8. Rights of the data subject

Data subjects have the right to be informed, the right to rectification of data, the right to deletion of data, the right to object, and the right to data portability. In addition, data subjects (where it is applicable to them) have a right to lodge a complaint with a competent data protection supervisory authority. Data subjects can withdraw previously granted consent for the processing of personal data at any time. The withdrawal of consent is only effective for the future. Processing that was carried out before the written withdrawal of consent is not affected.

9. Data protection for applications and in the application process

ADS Engineering GmbH collects and processes the personal data of applicants for the purpose of completing the application process. This processing may be carried out electronically. In particular, this is the case if an applicant transmits relevant application documents to us electronically, for example by email or using a web form on our website. If ADS Engineering GmbH signs an employment contract with an applicant, the transmitted data will be stored in accordance with statutory provisions for the purposes of establishing the employment relationship. If we do not sign an employment contract with the applicant, the application documents will be deleted automatically two months after the applicant is informed of the rejection.

10. Google Analytics

Our websites and apps use Google Analytics, a web analytics service provided by Google, Inc. (“Google”). To this end, Google Analytics also uses cookies (see section 3, above, regarding “Cookies”).

The information generated by these cookies regarding your use of our websites and apps (including the IP address of the data subject) will be transmitted to and stored on a Google server in the United States. Google will use this information to evaluate your use of the website, to compile reports on website activity for website operators, and to provide other website and internet-related services. Google may also pass this information on to third parties if legally required to do so or where third parties process this data on Google’s behalf. Google will not associate your IP address with any other data held by Google. You may refuse the use of cookies by selecting the appropriate settings on your browser. However, please note that if you do so, you may not be able to make full use of this website’s features.

By using this site, you agree to the processing of data about you by Google in the manner described above and for the aforementioned purpose.

11. XING, LinkedIn and Facebook plug-ins (“Like” button)

Our pages and apps incorporate plug-ins from social networks such as XING, LinkedIn and Facebook. If the data subject lives outside the United States and Canada, the controller responsible for processing personal data in the case of Facebook is Facebook Ireland Ltd., 4 Grand Canal Square, Grand Canal Harbour, Dublin 2, Ireland.

You can identify the plug-ins from the respective logos (X, in, f) on our site. An overview of all Facebook plug-ins is available here: http://developers.facebook.com/docs/plugins/. When you visit our pages and apps, the plug-ins establish a direct link between your browser and the respective server of the social network. This informs the operator of the social network that you accessed our page with your IP address.

If you click on the button while signed in to the social network, you can link to the contents of our pages and apps on your respective profile. This allows the social network to associate your visit to our pages and apps with your user account. The respective operator of the social network is always informed by the network component that the data subject has visited our website if they were logged in to the social network at the time of accessing our website. This takes place regardless of whether the data subject clicks on the component or not. If the data subject does not wish this information to be transmitted in this way, they can prevent transmission by logging out of their account before accessing our website.

The privacy policy published by Facebook, which is available at https://de-de.facebook.com/about/privacy/, provides information on the collection, processing and use of personal data by Facebook. Furthermore, it sets out what settings options Facebook offers for protecting the data subject’s privacy. Various applications are also available that allow users to suppress the transfer of data to Facebook.

Please note that, as the operator of the sites and apps, we receive no information about the content of the transmitted data or about how it is used by the operators of the social networks. Further information can be found in the privacy policies of XING (https://privacy.xing.com/de/datenschutzerklaerung), LinkedIn (www.linkedin.com/legal/privacy-policy?_l=de_DE) and Facebook (http://de-de.facebook.com/policy.php).

12. Google +1

The Google +1 button allows you to publish information on a worldwide basis. Via this button, you and other users receive personalised content from Google and our partners. Google stores both the information that you have given a +1 for content and information about the page you were viewing when you clicked on +1. Your +1 can be displayed as notifications along with your profile name and your photo in Google services, such as in search results or in your Google profile, or in other places on websites and advertisements online.

Google records information about your +1 activities in order to improve the Google services for you and others. To be able to use the Google +1 button, you need a public Google profile that is visible worldwide and which must include at least the name chosen for the profile. This name is used in all Google services. In some cases, it can also replace another name that you used when sharing content via your Google account. The identity of your Google profile may be displayed to users who know your email address or have other identifying information about you.

In addition to the usage purposes set out above, the information provided by you is used in accordance with the applicable Google data protection provisions. Google may publish summarised statistics about users’ +1 activities or pass these statistics on to users and partners such as publishers, advertisers or associated websites, for example.

13. Legal basis of processing

Within the scope of the EU GDPR, the provisions of Art. 6, para. 1(a), of the GDPR provide our company with a legal basis for processing steps in which we obtain consent for a specific processing purpose. If the processing of personal data is necessary for performing a contract to which the data subject is a party, as is the case with processing steps that are necessary for supplying goods or delivering another service or service in return, for example, processing is based on Art. 6, para. 1(b), GDPR. The same applies to processing steps that are necessary in order to implement precontractual measures, such as in cases of inquiries regarding our products or services. If our company is subject to a legal obligation that necessitates the processing of personal data, such as in order to meet tax obligations, processing is based on Art. 6, para. 1(c), GDPR.

In rare cases, the processing of personal data may be necessary in order to protect the vital interests of the data subject or of another natural person. This would be the case, for example, if a visitor to our company were to be injured and their name, age, health insurance fund data or other vital information had to be disclosed to a doctor, a hospital or other third parties. Processing would then be based on Art. 6, para. 1(d), GDPR. Lastly, processing steps could also be based on Art. 6, para. 1(f), GDPR. This provides the legal basis for processing steps that are not covered by any of the aforementioned legal bases, provided the processing is necessary in order to safeguard a legitimate interest of our company or of a third party, except where such an interest is overridden by the interests or fundamental rights and freedoms of the data subject.

14. Platform services and hosting

The purpose of these services is to host and operate key components of the application for this application so that this application can be provided from a uniform platform. Such platforms provide the supplier with a whole series of tools – such as analysis and comment functions, user and database management, e-commerce and payment processing – that involve the processing of personal data. Some of these services use geographically dispersed servers, making it difficult to determine the location in which the personal data is stored.

ADS Engineering GmbH’s apps are distributed via Apple’s App Store and the Google Play Store. These stores are platforms for the distribution of mobile apps provided by Apple Inc. or Google Ireland Limited. The fact that the applications are distributed via these channels means that Apple and Google collect basic usage statistics and provide reporting functions that allow the provider to display usage statistics and measure the performance data of these applications. Most of this information is processed on an opt-in basis. Users can deactivate this analysis function directly via their device settings. Further information on managing the analysis settings is available for users on the support websites of Apple and Google.

15. Hosting and backend infrastructure

The purpose of this type of services is to host data and files so that apps can be managed and used. Furthermore, these services can provide a ready-made infrastructure that handles specific functions or entire components of an application. These services can but need not necessarily operate via geographically dispersed servers, making it difficult to determine where the personal data is actually stored.

Vuforia is a web-hosting and backend service provided by PTC, Inc. The personal data collected includes various pieces of user data, which are described in the privacy policies of PTC, Inc.

16. Period for which personal data is stored

The criterion for determining how long personal data is stored is the respective legal retention period. After this period has expired, the respective data is deleted as a matter of routine, provided it is no longer required to perform or initiate the contract.

17. Liability

Although ADS Engineering GmbH makes all reasonable efforts to ensure the accuracy of materials on our website and avoid disruptions, we assume no liability of any kind for incorrect information, disruptions, interruptions or other incidents that may lead to direct damages (e.g. computer failure) or indirect damages (e.g. lost profit) on your part. If you rely on information found on this website, you do so at your own risk.

This website may contain links to non-ADS Engineering GmbH websites. ADS Engineering GmbH has no control over third-party websites, does not necessarily vouch for them and assumes no liability for such websites. This includes the content, accuracy and functionality of said websites. We therefore recommend that you read the legal notices of such third-party websites carefully and keep up to date with possible changes.

In the event that you operate a third-party website and would like to include links to this website, ADS Engineering GmbH has no objections to the inclusion of such links, provided you use the correct homepage URL (i.e. no deep linking) and do not under any circumstances claim that you are associated with or promoted by ADS Engineering GmbH. “Framing” and similar practices are prohibited, and you must ensure that the link to the website opens a new window.

18. Statutory or contractual provisions regarding the provision of personal data; necessity in order to enter into a contract; obligation of data subjects to provide personal data; possible consequences of failure to provide such data

We hereby advise you that the provision of personal data is partly a statutory requirement (e.g. tax regulations) or can also result from contractual regulations (e.g. information relating to the contract partner). During conclusion of a contract, it can sometimes be necessary for a data subject to provide us with personal data that must then be processed by us. For example, the data subject is obliged to provide us with personal data if our company enters into a contract with them. Failure to provide the personal data would mean that the contract with the data subject could not be concluded.
